End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and Bear Den Labs Pty Ltd (ABN 64 686 731 046), ("Bear Den Labs," "we," or "us"). By downloading, installing, or using Bear's Bedtime Stories ("App"), you agree to the terms and conditions set forth in this Agreement.

1. Acknowledgment

You acknowledge that this Agreement is between you and Bear Den Labs only, not with Apple, and Bear Den Labs, not Apple, is solely responsible for the App and its content.

2. Scope of License

Bear Den Labs grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely on Apple-branded products owned or controlled by you, strictly in accordance with this Agreement and Apple's App Store terms and Usage Rules.

3. Maintenance and Support

Bear Den Labs is solely responsible for providing any maintenance and support services concerning the App, as specified in this Agreement or required under applicable law. Apple has no obligation to furnish any maintenance or support services for the App.

4. Parental Responsibility

You acknowledge and agree that Bear's Bedtime Stories is designed primarily for children, and parents or guardians hold full responsibility for supervising their child's use of the App, including all content consumed. Bear Den Labs is not liable for any inappropriate or unintended content exposure arising from unsupervised use of the App.

5. No Liability for Content

Bear Den Labs provides the App and its content solely for entertainment purposes. We do not guarantee the accuracy, appropriateness, or completeness of the content provided. Parents or guardians are fully responsible for all decisions concerning the suitability of content provided to their children. Bear Den Labs will not be held liable for any direct, indirect, incidental, or consequential damages arising from use or inability to use the App.

6. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied. Bear Den Labs disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by applicable law, Apple has no other warranty obligations concerning the App.

7. Product Claims

Bear Den Labs, not Apple, is responsible for addressing any claims related to the App, including, but not limited to: product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

8. Intellectual Property Rights

All rights, titles, and interests in and to the App, including copyrights, trademarks, and intellectual property rights, are exclusively owned by Bear Den Labs or its licensors. You may not reproduce, modify, distribute, or create derivative works from the App or its content without explicit written permission from Bear Den Labs. Bear Den Labs will handle any claims regarding infringement of intellectual property rights.

9. Legal Compliance

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App if third-party services are utilized.

11. Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

12. Termination

This Agreement remains effective until terminated by either party. Bear Den Labs may terminate your access to the App at any time, without notice, if you breach this Agreement. Upon termination, you must cease using the App immediately.

13. Governing Law

This Agreement is governed by and construed in accordance with the laws of Australia. Any disputes arising from this Agreement shall be subject to the jurisdiction of the courts located within Queensland, Australia.

This EULA is effective as of the date you first download, install, or use the App.
